He has handled many transactions and litigation for residential and commercial real estate disputes as well.

Mr. Cain has been retained as a legal expert in litigation in which Mr. Cain has provided expert witness testimony regarding the legal standard of care for attorneys in Tennessee who are hired to defend against lender foreclosure. Specifically, Mr. Cain has been designated as an expert witness to analyze the legal requirements that lenders must adhere to when they decide to foreclose on any property in Tennessee and the legal standards which Tennessee lawyers must meet when defending individuals against foreclosing lenders. Mr. Cain has identified numerous strategies in defending against foreclosures including filing Chapter 13 bankruptcy, initiating an adversary proceeding in bankruptcy court after the filing to establish the lender's failure of securitization, initiating litigation in state or federal court against foreclosing lenders, and the use of quiet title actions in state court against lenders who claim an interest or lien in real property. Mr. Cain has litigated real estate cases in bankruptcy court as well as state and federal courts. Mr. Cain is on the cutting edge of the legal theories and practice as they relate to foreclosure defense and wrongful foreclosure.
